1. Acceptance of Terms
By creating an account, downloading, or using Selin ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and Selin ("we," "us," or "our").
2. Eligibility
You must be at least 13 years old to use Selin. By using the App, you represent that you meet this requirement. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.
3. User Conduct
Selin has zero tolerance for objectionable content or abusive behavior. You agree not to post, share, or transmit content that is hateful, harassing, threatening, sexually explicit, defamatory, or otherwise harmful. You also agree not to impersonate others, spam users, or attempt to gain unauthorized access to any part of the App. Violations may result in immediate content removal and permanent account termination without notice.
4. User-Generated Content
You retain ownership of content you post ("User Content"). By posting, you grant Selin a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content within the App and in connection with our services (such as our website, email features, or future platform extensions). We will never sell your content or use it in paid advertising without your explicit permission. You represent that you have all rights necessary to grant this license and that your User Content does not violate any third-party rights. We reserve the right to remove any User Content at our sole discretion.
5. No Medical Advice
Selin is a community platform for sharing beauty and skincare routines. Nothing on the App constitutes medical, dermatological, or professional skincare advice. User-generated content reflects individual experiences and opinions only. Always consult a qualified healthcare professional before starting any new skincare regimen, especially if you have skin conditions, allergies, or medical concerns. We are not responsible for any adverse reactions or outcomes resulting from products or routines shared on the App.
6. Reporting & Moderation
Users may flag objectionable content or block abusive users at any time using the in-app tools. We commit to reviewing all reports within 24 hours and removing violating content promptly. Reported users may be suspended or permanently banned at our discretion. We reserve the right — but not the obligation — to monitor User Content.
7. Account Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, without prior notice or liability. You may delete your account at any time from your profile settings. Upon deletion, all your data will be permanently removed from our systems within 30 days, except where retention is required by law.
8. Intellectual Property
All content, design, code, trademarks, and materials comprising the App (excluding User Content) are owned by or licensed to Selin and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our express written permission.
9. DMCA & Copyright
If you believe your copyrighted work has been infringed on Selin, please contact us at support@getselin.app with: (a) identification of the copyrighted work claimed to be infringed; (b) identification of the infringing material and its location in the App; (c) your contact information; (d) a statement of good faith belief that the use is not authorized; and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.
10. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR SOLE RISK.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SELIN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $100.
12. Indemnification
You agree to indemnify, defend, and hold harmless Selin and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
13. Dispute Resolution & Arbitration
Any dispute arising out of or relating to these Terms or the App shall be resolved by binding individual arbitration under the rules of the American Arbitration Association, rather than in court. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. This arbitration provision does not apply to claims for injunctive relief or claims within the jurisdiction of small claims court.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
15. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes via the App or email at least 14 days before they take effect. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
